4 Factors That Can Complicate Child Custody

There is really no such thing as a “normal” child custody case, but some cases are more complicated than others. Illinois courts strive to put the child’s interests first by finding the type of custody arrangement that works best for the child. In most cases, this means some type of joint custody is the favored outcome.

In general, state courts prefer to allow a child some time with both parents. However, there are situations where a more standard custody arrangement is impossible or inappropriate. Child-rearing for divorced parents is not a one-size-fits-all situation. Children cannot attend one school half the time and another school the other half. If one parent is moving out of the state, it may be even more difficult to reach a custody schedule that allows children time with both parents. 
  • Abuse allegations - If there are any allegations that a parent has abused the child or the other parent, then the court will need to thoroughly investigate the alleged abuse before a final custody arrangement can be reached. Protecting children is the court’s number one concern. 
  • Disabled child - If your child has disabilities, including emotional or learning disabilities, then it is critically important that the parents remain a team when it comes to providing the best possible upbringing to the child. Unique solutions may be in order so that the child can have a sense of stability. 
  • Parental kidnapping - If one parent has unlawfully restricted the other parent’s access to the child or has traveled with the child absent a court order, this could throw a wrench in custody proceedings. 

Even for parents and children with unique situations, the right custody arrangement can be found, but it may take extra time or effort.
