Questions to Ask Your Illinois Divorce Attorney

Posted on in Divorce

cook county divorce lawyerIt is estimated that there are just under 100,000 attorneys in the state of Illinois. With so many law firms to choose from, it is critical for a potential client to know how to weed out those attorneys who will aggressively advocate for them and those that simply want to settle up cases as quickly as possible and just collect their fees.

When a person is facing serious legal issues, it is important to find the best attorney for their situation. The first step is speaking with those attorneys who specialize in the client’s needed area of law. If you have decided to end your marriage, you want to make sure you have an attorney who specializes in divorce and family law. You also want to have one that can answer the following questions in a way that will assure you that they will be looking out for your best interests.

What Is Your Experience Level?

While many think family law is a ‘safe’ or easy discipline, it is in fact extraordinarily complex. Over the past several years, the Illinois Marriage and Dissolution of Marriage Act went through a major overhaul that affected how child custody, child support, and other family law issues are addressed. If your attorney does not have significant family law experience, consistently staying on-top of the frequent changes that have taken place, it can have a significant detrimental impact on the outcome of your case.

Will You Be Handling My Case Personally?

It is sadly common for attorneys to bait and switch, holding out the most experienced or reliable member of their firm to land the case, and then delegating all the work to a junior associate or even a paralegal or other staffer without a law degree. If an attorney is evasive as to whether or not they will be personally handling your case, it is never a good sign.

What Is Your “Legal” Style?

It may sound inconsequential but understanding how an attorney likes to conduct themselves in court and while facing the opposing party can be a boon to help you decide whether or not they are a good fit for you. If you fear your divorce will be high-pressure and full of acrimony, you need an attorney who is comfortable in such a situation; if you have no such fears, a more laid-back legal professional may be a better bet.

How Will Fees and Other Financial Issues Be Handled?

Even if a couple has very few assets, most divorce cases still do require a decent outlay of funds. Many attorneys require a retainer or some sort of deposit that either reserves the attorney’s time for a set period, or is intended as payment that the attorney earns by working overtime. There are also filing fees and other incidentals that are usually covered by the attorney, who is then reimbursed by the client. However, not every attorney handles financial issues in the same way. This is why it is a good idea to ask about the financial aspect before concluding any kind of representation agreement.

What Do You Think the Timeline of My Case Will Be?

While no attorney can guarantee that a divorce case will conclude at a certain point, they can usually give a rough estimate, or at the very least, they should be able to advise you as to how quickly they like to work and how much time they will have to devote to your case.
